1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of store.houselevi.com (the "Site") and the purchase of any products offered by House Levitika Plus Ltd, a company incorporated in Kenya ("Company", "we", "us"). By accessing the Site or placing an order, you agree to be bound by these Terms and all applicable Kenyan laws and regulations. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years of age to use this Site and make purchases. By using the Site, you represent that you are 18 or older. We reserve the right to refuse service to anyone for any reason at any time.

3. Account Registration

• You may be required to create an account to place orders. You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current and complete information and to update it as necessary.
• You are responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorised use of your account at support@houselevi.com.

4. Products and Pricing

• All product descriptions, images and prices are subject to change without notice.
• Prices are displayed in Kenyan Shillings (KES) unless otherwise stated and are inclusive of applicable VAT where stated.
• We reserve the right to discontinue any product at any time.
• In the event of a pricing error, we reserve the right to cancel the order and refund any payment made.

5. Orders and Contract Formation

• Placing an order constitutes an offer to purchase. A contract is formed only when we send you an order confirmation email.
• We reserve the right to refuse or cancel any order at our discretion, including where products are out of stock, there is a suspected fraudulent transaction, or a pricing error has occurred.
• You will receive an email confirmation upon successful placement of your order.

6. Payment

• We accept payment via M-Pesa, credit/debit card, and other payment methods listed at checkout.
• Payment must be received in full before dispatch of goods.
• All transactions are processed through secure, PCI-DSS compliant payment processors. We do not store full card details on our servers.
• You warrant that you are the authorised holder of the payment method used.

7. Delivery and Shipping

• Delivery timelines are estimates only and are not guaranteed.
• Risk of loss and title for products pass to you upon delivery to the carrier.
• We are not liable for delays caused by customs, weather, or third-party delivery partners.

8. Returns, Refunds and Cancellations

• You may return eligible products within 14 days of receipt, provided they are unused, in original packaging and accompanied by proof of purchase.
• Certain items are non-returnable (e.g. personalised items, perishables, digital goods).
• Refunds will be processed to the original payment method within 7–14 business days of receiving the returned item.
• Shipping costs for returns are at the customer's expense unless the return is due to our error or a defective product.

9. Intellectual Property

All content on this Site — including but not limited to text, graphics, logos, images, product descriptions, and software — is the property of House Levitika Plus Ltd or its content suppliers and is protected by Kenyan and international copyright and intellectual property laws. You may not reproduce, distribute, modify or create derivative works without our express written consent.

10. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law.
• Transmit any unsolicited commercial communications.
• Introduce malware, viruses or any other harmful code.
• Attempt to gain unauthorised access to any part of our systems or the accounts of other users.
• Engage in fraudulent activity or misrepresent your identity.

11. Limitation of Liability

To the fullest extent permitted by applicable law, House Levitika Plus Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or purchase of products, including loss of profits, data, goodwill or other intangible losses. Our total liability for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount you paid for the specific product giving rise to the claim.

12. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of viruses.

13. Indemnification

You agree to indemnify, defend and hold harmless House Levitika Plus Ltd and its officers, directors, employees and agents from any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your infringement of any rights of a third party.

14. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising from these Terms or your use of the Site shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to mediation and, if still unresolved, to the exclusive jurisdiction of the courts of Nairobi, Kenya.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Continued use of the Site after changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

18. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, Refund Policy and Shipping Policy, constitute the entire agreement between you and House Levitika Plus Ltd regarding your use of the Site.
